Achiliz Apparel® — Terms of Service

Overview
These Terms of Service (“Terms”) govern your access to and use of the website, store, products, content, features, and services provided by Achiliz Apparel® (“Achiliz,” “we,” “us,” “our”) (collectively, the “Services”). Our store is hosted by Shopify. By using the Services, you agree to these Terms and our Privacy Policy and Return & Refund Policy (together, the “Policies”). If you do not agree, do not use the Services.

1. Access & Accounts

You represent that you are the age of majority in your province/state and have legal capacity to enter a contract. You are responsible for safeguarding your account credentials and all activity under your account. You may not transfer, sell, or license your account.

2. Product Information

We strive for accuracy, but colors/appearance can vary by device and lighting. Descriptions, specs, and availability may change without notice. We may limit quantities or refuse sales to any person, household, region, or jurisdiction at our discretion.

Achiliz Apparel works with trusted Canadian, American, and European manufacturing partners to uphold quality, ethical production, and durability.

3. Orders & Acceptance

Your order is an offer to purchase. We may accept or decline any order (including after submission) for reasons including inventory limits, payment issues, suspected fraud, or pricing/description errors. An order is accepted only when we send a written confirmation. If we cancel or modify an order, we’ll attempt to notify you using the contact details provided.

• Personal use only. You represent purchases are for personal/household use, not resale or export.

• Cancellations. We may be unable to cancel after processing.

• Returns. Purchases are subject to our Return & Refund Policy.

4. Pricing, Taxes & Billing

Prices are shown in CAD unless stated otherwise and may change without notice. Posted prices exclude taxes, shipping, and any customs or import charges unless expressly stated. You agree to provide current, accurate billing and payment information and authorize us (and our payment processors) to charge your selected method for your order total, including applicable taxes, shipping, and fees.

You represent and warrant that: (i) you are authorized to use the payment method; (ii) information is true and complete; (iii) charges will be honored; and (iv) you will pay all amounts due. Promotions may be limited and cannot be combined unless we state otherwise. We may correct errors (including pricing) and cancel/refund affected orders.

5. Shipping, Delivery & Risk of Loss

Delivery timelines are estimates only. We are not liable for delays caused by carriers, weather, customs, or events beyond our control. Title and risk of loss pass to you upon our delivery to the carrier. For USA shipments, all duties, taxes, customs, and brokerage fees are the customer’s responsibility (see also our Shipping and Return policies).

6. Intellectual Property

The Services and all content, trademarks, logos, product names, images, and designs are owned by Achiliz or its licensors and are protected by applicable IP laws. You may use the Services for personal, non-commercial use only. No rights are granted except as expressly stated. You may not copy, modify, distribute, display, create derivative works from, or exploit the Services or any content without our prior written consent.

7. Optional Tools & Third-Party Links

We may provide access to third-party tools or link to third-party sites. These are provided “as is” without warranties. Your use is at your own risk and subject to those third parties’ terms and policies. We are not responsible for third-party content, products, or services.

8. Relationship with Shopify

Achiliz Apparel® is powered by Shopify. Sales are made directly with Achiliz. By using the Services, you acknowledge Shopify is not responsible for your purchases and you release Shopify from claims arising from your transactions with Achiliz.

9. Feedback & User Content

If you submit reviews, suggestions, photos, or other content (“Feedback”), you grant Achiliz a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display such Feedback in any media for operating and improving the Services and for marketing. You represent you own/hold rights to the Feedback, it is accurate and lawful, and it complies with these Terms. We may remove Feedback that violates rights or policies.

10. Prohibited Conduct

You may not use the Services to: (a) violate laws; (b) infringe IP or privacy rights; (c) harass, defame, or abuse; (d) transmit malware, spam, or scraping; (e) misrepresent your identity; (f) interfere with security or operation; (g) collect others’ data without consent; (h) attempt to circumvent limits (including purchase limits, promo restrictions); or (i) engage in fraudulent activity, chargeback abuse, or resale. We may suspend or terminate access for violations.

11. Privacy

Your use of the Services is subject to our Privacy Policy and Shopify’s privacy terms. Information may be processed outside your jurisdiction to provide the Services.

12. Errors & Availability

We may correct typographical errors, inaccuracies, or omissions (including pricing, availability, shipping charges, and transit times) and update information without prior notice, including after you submit an order.

13. Disclaimer of Warranties

Except as expressly stated by Achiliz in writing, the Services and products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, durability, and non-infringement. We do not warrant uninterrupted, timely, secure, or error-free use. Some jurisdictions do not allow limitations on implied warranties; if so, those limitations may not apply to you.

14. Limitation of Liability

To the fullest extent permitted by law, in no event shall Achiliz, our owners, officers, employees, affiliates, agents, contractors, service providers, or licensors be liable for indirect, incidental, special, consequential, punitive, or exemplary damages; or for lost profits, revenue, savings, data, or replacement costs, arising from or related to your use of the Services or products. Our maximum aggregate liability for any claim shall not exceed the amount you paid to Achiliz for the product or service giving rise to the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless Achiliz and our affiliates, officers, directors, employees, agents, contractors, and service providers from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Services, or your violation of law or third-party rights.

16. Suspension & Termination

We may suspend or terminate your access to the Services (in whole or part) at any time, with or without notice, including for violations, suspected fraud, abuse, chargeback abuse, or security risks. You remain responsible for all amounts due up to termination. Sections that by nature should survive (including IP, Feedback, Disclaimers, Limitation of Liability, Indemnification, Governing Law) survive termination.

17. Force Majeure

We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, weather, labor disputes, war, terrorism, embargoes, government actions, epidemics/pandemics, carrier failures, or internet outages.

18. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms without restriction.

19. Severability; Waiver; Entire Agreement

If any provision is unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remainder will remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Policies, are the entire agreement between you and Achiliz regarding the Services and supersede prior communications.

20. Governing Law & Venue

These Terms are governed by the laws of the Province of Alberta, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You consent to the exclusive jurisdiction and venue of the courts located in Alberta, Canada for all disputes not subject to applicable consumer-protection venue rights.

21. Changes to These Terms

You can review the most current version at any time on this page. We may update these Terms by posting changes. Material changes will be notified in accordance with applicable law and are effective as stated in the notice. Your continued use of the Services after changes become effective constitutes acceptance.
